These Terms of Service (“Terms”) are a legal agreement between you and NM Exam Prep LLC (“NM Exam Prep,” “we,” “us,” or “our”). By creating an account, enrolling in a course, or otherwise accessing or using this site and its content (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility & Accounts
You must be at least 18 years old and provide accurate, current information. Your account is personal to you. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You may not share your account, share your credentials, or allow anyone else to access the Service through your account.
2. License to Use the Service
Subject to these Terms and payment of any applicable fees, NM Exam Prep grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and view the course materials to which you have been granted access, solely for your own individual exam preparation and study. This license grants no ownership rights and includes no right to download, retain, or redistribute the materials except where a feature expressly permits it.
3. Intellectual Property; Copyright
All content made available through the Service including: text, study manuals, PDFs, practice questions and quizzes, audio and video recordings (including “deep dive” lessons), images, and the selection, coordination, and arrangement of that content, is owned by NM Exam Prep LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. © NM Exam Prep LLC 2026. Except as expressly permitted in these Terms, you may not, in whole or in part: copy, download, record, screen-capture, photograph, reproduce, republish, transmit, distribute, publicly display or perform, sell, sublicense, rent, lend, or create derivative works from any content; nor may you remove, obscure, or alter any copyright, trademark, or other proprietary notice.
You may not circumvent, disable, bypass, or interfere with any security, access-control, encryption, digital-rights-management, or streaming-protection measure used to protect the content (including protections applied to audio and video lessons), nor assist or encourage others to do so.
4. Prohibited Conduct
You agree not to: (a) share, resell, sublicense, or otherwise provide access to the Service or its content to any third party; (b) use any automated means (bots, scrapers, downloaders) to access, harvest, or copy content; (c) reverse engineer, decompile, or attempt to extract source code, decryption keys, or underlying materials; (d) use the Service for any unlawful purpose or in violation of these Terms; or (e) introduce malware or otherwise disrupt or interfere with the Service or its security.
5. Educational Use Only; No Guarantee of Results
The Service provides exam-preparation and educational materials only. NM Exam Prep does not guarantee that you will pass any licensing, certification, or other examination, or achieve any particular score or result. Content is provided for general educational purposes and does not constitute legal, tax, financial, investment, insurance, or other professional advice.
6. No Affiliation or Endorsement
NM Exam Prep is an independent educational provider. The Service is not affiliated with, endorsed by, sponsored by, or administered by FINRA, NASAA, the North American Securities Administrators Association, any state insurance department or securities regulator, any examination administrator (such as Prometric or Pearson VUE), or any other governmental or regulatory authority. All third-party names and trademarks are the property of their respective owners and are used, if at all, for identification only.
7. Fees, Purchases & Refunds
Access to certain courses or content may require payment of fees. Unless expressly stated otherwise at the time of purchase, all fees are non-refundable.
8. Termination
We may suspend or terminate your access to the Service, in whole or in part, at any time and without refund if you violate these Terms or misuse the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.
9. Disclaimer of Warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the content is accurate, complete, current, or error-free, or that the Service will be uninterrupted or secure.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NM EXAM PREP LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO NM EXAM PREP FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless NM Exam Prep LLC and its owners, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Service.
12. Changes to the Service and Terms
We may modify or discontinue the Service, and we may revise these Terms, at any time. Material changes to these Terms will be posted here with an updated effective date, and where required you will be asked to accept the revised Terms. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico.

1. Who we are
NM Exam Prep ("we", "us", "our") provides online study courses and practice materials that help candidates prepare for New Mexico insurance licensing examinations. This notice applies to our learning platform at learn.nmexamprep.com and our enrollment pages. If you have any questions, contact us at ian@nmexamprep.com.
2. Information we collect
- Account information you or your purchaser provide: your name and email address, and, if you choose to provide it, your National Producer Number (NPN).
- Enrollment and payment information. Payments are processed by our payment provider, Stripe. We receive confirmation of payment and limited billing details; we do not receive or store your full card number.
- Course activity. Your progress, quiz and exam attempts, scores, completion records, and certificates.
- Technical and usage data. IP address, browser and device information, log data, and pages viewed, collected automatically when you use the platform.
- Communications. Messages you send to us, such as support requests.
3. How we use your information
- To create and administer your account and enroll you in courses.
- To deliver course content, track progress, and issue certificates of completion.
- To process payments and provide receipts through our payment provider.
- To provide customer support and respond to your requests.
- To secure the platform, prevent fraud and abuse, and maintain records we are required to keep.
- To improve our courses and services.
4. How we share information
We do not sell your personal information. We share it only as needed:
- Service providers who operate the platform on our behalf, including our payment processor (Stripe) and our hosting and infrastructure providers. They may use your information only to provide services to us.
- Legal and regulatory reasons where required by law, or to protect our rights, users, or the public.
- Business transfers in connection with a merger, acquisition, or sale of assets, subject to this notice.
5. Cookies and similar technologies
Our platform uses cookies that are necessary for signing in, keeping your session active, and remembering your preferences. Your browser can be set to refuse cookies, but some features of the platform may not work properly if you do.
6. Data retention
We keep your account and course records for as long as your account is active and as needed to provide the service, and afterward for as long as we have a legitimate business or legal reason to do so, such as recordkeeping for completed courses and financial records.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
8. Your rights and choices
You may request to access, correct, or delete your personal information, or ask questions about how it is handled, by contacting us at ian@nmexamprep.com. We will respond consistent with applicable law. You can also update much of your account information from within your profile.
9. Children's privacy
Our courses are intended for adults pursuing professional licensing and are not directed to children. We do not knowingly collect personal information from children.
10. Changes to this notice
We may update this Privacy Notice from time to time. When we make material changes, we will post the updated notice and revise the effective date below, and where appropriate ask you to review it again.
